TERMS AND CONDITIONS

Basis of Rates: All prices are based on two persons sharing a room. All prices and fares are quoted in U.S. dollars. The rates are based on current tariffs and are subject to change due to unforeseen circumstances. While we will do everything possible to maintain the listed prices, if it is necessary to levy a surcharge, we reserve the right to do so, and notification will be given at the time of final invoicing.

 

Eligibility: Participants in a PPT Photography Adventure Trip, Workshop and Private Guided Trip must be 18 or over. Anyone under 18 must be accompanied by a parent or guardian for the entire journey.

 

Included in Trip Cost: Accommodations and meals as indicated in the itinerary (B = breakfast, L = lunch, D = dinner); educational materials; pre-departure information; and sightseeing noted as included in the itinerary, unless otherwise noted on the itinerary page; ground transportation during the Trip; transfers to and from group flights where applicable; services of Prophototrip experts, lecturers, guides, Trip manager, and any other staff. Please note: the "B, L, D" notations apply to the period during the Trip only and do not include any meals on flights to/from the trip. Internal airfare is included on some international Trips as indicated in the itinerary. Note: Although breakfasts may be listed as included, some hotels do not offer packages that include breakfast. Prophototrip, its partners, travel agents or Trip operators always book the best accommodations baed on the group and never compromise the quality of the hotel for the benefit of a breakfast package.

 

Not Included: Air transportation and related fees (except as indicated in the itinerary); activities noted as excursions and/or noted as optional in the itinerary; gratuities, unless otherwise noted on the itinerary page; passport and visa expenses; baggage/accident/cancellation insurance; personal expenses, such as laundry, telephone calls, and alcoholic beverages; and any other items not specifically noted as included.

 

Accommodations: Prophototrip reserves the right to change accommodations based on our final attendance count, pricing and other factors that might influence our decision. We typically stay in hotels in the 4-star category. Not all destinations offer these types of properties. We look for unique hotels which offer cultural, historic and/or authentic features. Depending on the size of the group, smaller boutique hotels may have limited room inventory. In some countries or in remote locations, we may be limited to hotels, lodges, bed and breakfasts or branded chain hotels of lesser quality. If we decide to operate a Trip with three (3) or less guests, we reserve the right to select accommodations that work within our budget. This could mean that we downgrade the hotels to a 3-star category. Although this rarely happens, we reserve the right to potentially make these changes. Breakfast is included only if included in our room rates.

 

Single/Shared Accommodations: A limited number of single rooms/cabins are available at an extra cost on a first-come, first-served basis. We will assist persons requesting a roommate. Participants will be notified if a suitable roommate is not available, in which case the single rate will be charged.

 

Early Arrival and Late Departure Accommodations: We offer our guests the convenience of booking early arrival and late departure hotel rooms. We base the price of these accommodations on an average amount we expect to pay for the hotel room in any of the hotels we may consider using. It is not our intention nor our objective to profit from these hotel bookings, however prices are listed years in advance so the price we pay can be +/- the actual price listed. Rooms are typically in the superior or deluxe categories. We highly recommend that our guests reserve early arrival or late departure rooms through PPT for their own convenience and the convenience of the group. 

 

Payments, Cancellations and Refunds: To reserve space on a PPT Photography Adventure Vacation, Trip, or Workshop, a $1000 per-person deposit is required. Final payment is due no later than 90 days prior to departure. Balance payments may be made by bank wire or bank check. Balance payments may also be made by credit card or PayPal to a maximum amount of $5,000 per registration. A credit card or bank card convenience fee of 3.5% may be applied to balance payments. Your reservation may be canceled if full payment has not been received by 90 days prior to departure. For reservations made within 90 days of the departure date, full payment is required within 5 business days of the reservation. All cancellation notices must be received in writing and will become effective as of the date of the postmark (standard mail or electronic). If you cancel 150 days or more prior to departure, a refund less an administrative fee of $400 per person will be applied. Per-person charges for cancellations that occur less than 150 days prior to departure ("Cancellation Penalty Period") are as follows: 121-149 days prior to departure:  100% refunded; 91-120 days prior to departure: 75% refund on the amount paid; 61-90 days prior to departure: 50% refund on the amount paid; 60 or fewer days prior to departure: no refunds (no exceptions). This policy also applies to pre- and post-trip extensions, excursions, early arrival rooms and late departure rooms. Any revisions made within the Cancellation Penalty Period, such as a change in departure date or choice of trip, are subject to this cancellation policy. Any airline tickets issued are subject to the carrier's refund policy. Leaving a Trip in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of a Trip. We reserve the right to cancel any trip because of inadequate enrollment that makes the trip economically infeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the participants. If a Trip is canceled prior to departure, the Trip operator will provide you with a full refund of monies paid to the Trip operator; except in the event that the cancellation is due to a significant event that makes it infeasible to operate the Trip as planned, in which case the Trip operator will provide you with a refund and/or credit toward a future PPT Photography Adventure Trip, Workshop or Private Guided Trip equivalent to monies paid to the Trip operator. If we cancel the trip in progress, you will receive a prorated refund based on the number of days not completed on the Trip. We will not be responsible for any refund for nonrefundable airline tickets or for any airline tickets purchased by the passenger directly from an airline or travel agent. All refunds will be processed within 7-10 business days. We strongly suggest travel insurance to protect your investment. 

 

To reserve space on a PPT Photo Safari, Polar Expedition, Cuba People-to-People Photo Adventure, 24 Hours of Le Mans Photo Adventure and/or Private Guided Photo Adventure, final payment is due no later than 180 days prior to departure. Balance payments may only be made by bank wire or bank check. Your reservation may be canceled if full payment has not been received by 180 days prior to departure. For reservations made within 180 days of the departure date, full payment is required within 5 business days of the reservation. All cancellation notices must be received in writing and will become effective as of the date of the postmark (standard mail or electronic). If you cancel 180 days or more prior to departure, a refund less an administrative fee of $500 per person will be applied. Per-person charges for cancellations that occur less than 210 days prior to departure ("Cancellation Penalty Period") are as follows: 181-210 days prior to departure: 100% refunded; 151-180 days prior to departure: 75% refund on the amount paid; 121-150 days prior to departure: 50% refund on the amount paid; 120 or fewer days prior to departure: no refunds (no exceptions). This policy also applies to pre- and post-trip extensions, excursions, early arrival rooms and late departure rooms. Any revisions made within the Cancellation Penalty Period, such as a change in departure date or choice of trip, are subject to this cancellation policy. Any airline tickets issued are subject to the carrier's refund policy. We will not be responsible for any refund for nonrefundable airline tickets or for any airline tickets purchased by the passenger directly from an airline or travel agent. All refunds will be processed within 7-10 business days. We strongly suggest travel insurance to protect your investment.

 

Photo Day Trip payments are due in full at the time of registration. Cancellations within 7 days of the Photo Day Trip date are non-refundable. All cancellation notices must be received in writing and will become effective as of the date of the postmark (standard mail or electronic). Reservation dates may be changed no less than 7 days prior to your photo day Trip date. It is the guests responsibility to arrive at the correct pickup location prior to the scheduled pickup time. No shows will be charged in full. All refunds will be processed within 7-10 business days.

 

Weather: We reserve the right to cancel, reschedule or re-route a PPT Photography Adventure Trip, Workshop, Private Guided Trip or Photo Day Trip up until last minute, due to inclement or unsafe weather conditions, safety or other uncontrollable circumstances. For Photo Day Trips we will try to reschedule or adjust to a more accessible destination or if necessary, issue a full refund. New York Aerial Doors-Off Photo Adventure or Experience flights will be rescheduled or cancelled if the weather conditions are not acceptable for flight. Cancellations will receive a full refund. All refunds will be processed within 7-10 business days.

 

Travel Insurance: Prophototrip strongly recommends purchasing travel insurance that protects you and your investment in the event of a sudden emergency before or during your trip and coverage for trip cancellation or interruption, illness, injury, and damage, loss or theft of baggage, as well as emergency assistance. Travel insurance must be secured and paid for within 30 days of payment. This applies to deposits and balance due payments. Travel insurance can be purchased through Prophototrip or other parties.

 

Photographer Leaders: The itineraries and staff presented on this website are subject to modification and change by Prophototrip or its designated Trip operator. Every reasonable effort will be made to operate programs as planned, but alterations may still occur after final itineraries are sent. Prophototrip makes every attempt to provide photographic opportunities during the best possible light, but this is often compromised by daily itineraries and travel schedules. Since the best light is just after sunrise and just before sunset when the sun is low, it is impossible to visit all locations during these limited hours. Prophototrip makes every attempt to instruct throughout the adventure. It is important that you arrive with a working knowledge of your cameras settings. Prophototrip does not provide any classroom instruction. Instructions are conducted on site using walk-n-talk techniques. Don’t be afraid to ask questions and seek out your leader when you need help. Prophototrip makes no guarantees that you will become a better photographer.

Health Requirements: You must be in good physical and mental health. You must be able to maintain the pace of the group throughout the Trip. Any physical condition, diet, or treatment requiring special attention must be reported in writing when you register. Failure to participate in daily activities due to physical or mental health will not result in any refund. For special dietary requirements, we do our best to convey this information to restaurants and food establishments, but communication of these requirements to restaurants and food establishments is ultimately your responsibility.

 

Photography: We reserve the right to take photographs or videos during the operation of any Trip or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. By making a reservation on a PPT Photography Adventure Trip, Workshop or Private Guided Trip, the participant agrees to allow his/her likeness to be used by Prophototrip, Prophototrip-authorized third parties, and the Trip Operator without compensation to the participant. If the participant prefers that his/her likeness not be used, he/she must notify us in writing prior to departure of the trip. Copyright in all photographs, video, and related materials created by the participant ("Trip Materials") shall belong to the participant upon creation. The participant grants to Prophototrip a non-exclusive, worldwide, irrevocable license to use any Trip Materials provided to Prophototrip and/or the Trip Operator in any media for the following limited purposes: editorial use, promotion of this editorial use, promotion of Prophototrip travel programs, or promotion of the mission of Prophototrip.

 

Force Majeure: Prophototrip will not be liable for any delay in, change to or cancellation of trips due to 'Force Majeure'. 'Force Majeure' means a circumstance beyond the reasonable control of Prophototrip and includes, but is not limited to, war or threat of war, riot, civil strife, terrorist activity, industrial dispute, disease, industrial or nuclear disaster, adverse weather conditions, fire and strikes.

 

Dispute Resolution: If the participant has a complaint, he/she should first inform the adventure leader or Trip operator while on the adventure so that the adventure leader or Trip operator can attempt to rectify the matter. If the participant is still dissatisfied, he/she should submit the complaint in writing to Prophototrip within 30 days of the completion of the adventure. Any controversy or claim arising out of or relating to this Agreement, website, brochures, or any other literature concerning this adventure, or the breach thereof, including without limitation any claim related to illness, injury, or death, shall be subject to the following conditions: 1) the dispute will be governed by New York State law; 2) the parties agree that they will attempt in good faith to settle any and all disputes arising out of, under or in connection with this Agreement, including without limitation the validity, interpretation, performance and breach hereof, through a process of mediation in the state of New York, county of Suffolk. under the supervision of a mutually agreed upon mediator; 3) in the event that mediation fails to settle such a dispute, the parties agree that they will proceed to arbitration in state of New York, county of Suffolk. using one arbitrator pursuant to the then existing rules of the American Arbitration Association; 4) the maximum amount of recovery to which a participant will be entitled under any and all circumstances will be the published cost of the participant’s adventure with Prophototrip. This agreement to arbitrate does not waive or modify any liability release agreed by the participant.

 

Other: Other Terms and Conditions may apply to some Trips and will be provided with pre-trip emails or mailings. By registering for a PPT Photography Adventure Trip, Workshop or Private Guided Trip, the participant agrees to the Responsibility statement and the Terms and Conditions herein.
